Welcome to DevSecura. These Terms and Conditions ("Terms") govern your access to and use of our website, products, software, training programs, cybersecurity services, consulting services, and any other offerings provided by DevSecura ("Company", "we", "our", or "us").

By accessing our website or purchasing any product or service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Services

The Company reserves the right to modify, discontinue, suspend or replace any service without prior notice.

2. Eligibility

By using our services, you confirm that:

  • You are at least 18 years old or have legal guardian consent.
  • You have authority to enter into this agreement.
  • All information provided is accurate and complete.

3. Authorized Security Testing

You may only request penetration testing or security assessments for systems that:

  • You own; or
  • You have written authorization to test.

DevSecura shall not be liable for any consequences arising from false ownership claims or unauthorized testing requests.

The client accepts full legal responsibility for obtaining all required permissions before requesting any testing.

4. Scope of Work

Every project is limited strictly to the scope agreed upon before commencement.

Any additional assets, applications, APIs, IP addresses, domains, cloud environments, or infrastructure not included within the agreed scope shall require separate approval and may incur additional charges.

5. Intellectual Property

All reports, software, documentation, methodologies, source code, training materials, videos, presentations, templates, tools, scripts, logos, trademarks, and website content remain the exclusive intellectual property of DevSecura unless explicitly transferred through a written agreement.

No content may be copied, distributed, modified, reverse engineered, sold, republished, or commercially exploited without prior written permission.

6. Client Responsibilities

The client agrees to:

  • Provide complete and accurate information.
  • Cooperate during engagements.
  • Provide required credentials where applicable.
  • Maintain secure backups before testing.
  • Notify internal stakeholders before testing.
  • Ensure legal authorization for all assets.

Failure to cooperate may delay or suspend the project without refund.

7. Confidentiality

DevSecura treats client information as confidential.

We implement reasonable administrative, technical, and organizational safeguards to protect client information.

However, confidentiality obligations do not apply where disclosure is required by law, court order, governmental authority, or where information becomes publicly available through no fault of DevSecura.

8. Security Testing Risks

The client acknowledges that penetration testing may involve:

  • Temporary service interruptions
  • Increased system resource usage
  • Detection by security monitoring tools
  • Triggering of alerts
  • Temporary degradation in performance

Although industry best practices are followed, DevSecura shall not be liable for incidental downtime resulting from agreed testing activities.

9. Reports

Security reports are based on findings identified during the engagement period.

The absence of identified vulnerabilities does not guarantee that systems are completely secure.

Cybersecurity is a continuously evolving field, and new vulnerabilities may emerge after the assessment.

10. Courses & Digital Products

All training materials, videos, PDFs, software, templates, downloadable files, and digital products are licensed solely for personal use.

Sharing, redistribution, resale, screen recording, uploading, copying, or unauthorized commercial use is strictly prohibited.

Violation may result in permanent access termination and legal action.

11. Payment

Full payment is required unless otherwise agreed in writing.

Projects may commence only after payment confirmation.

Invoices remain payable according to the agreed payment terms.

Delayed payments may result in suspension or termination of services.

12. No Guarantee

While DevSecura strives to provide high-quality professional services, we do not guarantee:

  • Complete elimination of vulnerabilities
  • Compliance certification approval
  • Protection against future attacks
  • Employment after career guidance
  • Examination success
  • Business growth
  • Security against future zero-day vulnerabilities

13. Limitation of Liability

To the maximum extent permitted by law, DevSecura shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Business interruption
  • Loss of revenue
  • Loss of profits
  • Data loss
  • Reputation damage
  • Third-party claims
  • Cyberattacks occurring after completion of services

Our maximum liability, if any, shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

14. Third-Party Services

Our services may involve third-party software, cloud platforms, APIs, or security tools.

DevSecura is not responsible for the performance, security, availability, or policies of third-party providers.

15. Suspension or Termination

We reserve the right to suspend or terminate services immediately if:

  • Fraud is suspected.
  • Payment obligations are not fulfilled.
  • Abuse of our staff occurs.
  • Illegal activities are detected.
  • Unauthorized testing requests are made.
  • Our intellectual property is misused.

16. Indemnification

The client agrees to indemnify and hold harmless DevSecura, its directors, employees, consultants, and affiliates from any claims, liabilities, losses, damages, costs, or legal expenses arising from:

  • Unauthorized testing requests.
  • Misuse of our reports.
  • Violation of applicable laws.
  • Client negligence.

17. Privacy

Our collection and processing of information are governed by our Privacy Policy and Data Retention Policy.

18. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Goa, India.

19. Changes to Terms

DevSecura reserves the right to update or modify these Terms at any time.

Continued use of our services constitutes acceptance of the updated Terms.
